1. Agreement to Terms

By accessing or using GreatHearts (greathearts.io), you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the platform.

GreatHearts is operated by Futures Group (Pty) Ltd (Reg: 2024/663048/07), trading as SA Rejects.

These terms constitute a legally binding agreement between you and GreatHearts.

2. Who Can Use GreatHearts

To use GreatHearts, you must:

• Be at least 18 years old
• Be capable of entering into a binding contract
• Provide accurate, truthful information
• Not be prohibited from using the service under applicable law

By creating an account, you represent that you meet these requirements.

3. Your Account

Account Creation

You may need to create an account to access certain features. You're responsible for:

• Providing accurate information
• Keeping your login credentials secure
• All activity that occurs under your account

LinkedIn Verification

We require LinkedIn verification to confirm your professional identity and generate your profile URL. This is a one-time verification, not a login method. You must have legitimate ownership of the LinkedIn profile you verify.

One Account, One Profile

Each user may have only one GreatHearts account and profile. Creating multiple accounts or profiles is prohibited.

4. Your Content

Ownership

You retain ownership of all content you submit to GreatHearts, including your profile information, work history, proof of work, methodologies, and attachments ("Your Content").

License to Us

By submitting content, you grant GreatHearts a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute Your Content solely to:

• Operate and provide the service
• Display your profile to other users, employers, and recruiters
• Promote GreatHearts (with your permission for specific promotional uses)

This license ends when you delete Your Content or your account, except for content that has been shared with others or is retained in backups.

Your Responsibilities

You represent that Your Content:

• Is accurate and truthful
• Does not infringe any third party's intellectual property or rights
• Does not contain false, misleading, or fraudulent information
• Does not violate any applicable law

Prohibited Content

You may not submit content that:

• Is false, misleading, or deceptive
• Infringes intellectual property rights
• Contains malware, viruses, or harmful code
• Is defamatory, obscene, or offensive
• Promotes illegal activities
• Violates any person's privacy
• Misrepresents your qualifications, experience, or identity

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Impersonate another person or misrepresent your affiliation
• Attempt to gain unauthorized access to the platform or other accounts
• Interfere with or disrupt the platform's operation
• Scrape, harvest, or collect user information without consent
• Use automated systems (bots, scrapers) without our permission
• Spam, solicit, or send unsolicited communications to other users
• Circumvent any security measures or access controls
• Use the platform to discriminate against anyone based on race, gender, religion, nationality, disability, or any protected characteristic

6. Employer and Recruiter Access

Visibility Settings

You control whether your profile is discoverable by employers and recruiters through your visibility settings.

No Guarantee of Opportunities

GreatHearts facilitates connections between professionals and potential employers or recruiters. We do not guarantee:

• That you will receive job offers or opportunities
• The quality, legitimacy, or suitability of any opportunity
• The conduct of employers or recruiters on the platform

Your Due Diligence

You are responsible for evaluating any opportunity and conducting your own due diligence before entering into any employment or business relationship.

7. Fees and Payments

Free Tier

Basic profile creation and publishing is currently free.

Premium Features

We may offer premium features or services for a fee. Pricing and terms will be clearly disclosed before purchase.

Future Placement Fees

If GreatHearts facilitates a job placement, we may charge placement fees as disclosed at the time. You will be notified of any such fees before they apply.

Refunds

Refund policies for paid services will be specified at the time of purchase.

8. Intellectual Property

Our Platform

GreatHearts, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the platform without our written permission.

Trademarks

"GreatHearts" and our logo are trademarks. You may not use them without our permission.

Feedback

If you provide feedback or suggestions about GreatHearts, we may use them without obligation to you.

9. Third-Party Services

GreatHearts may integrate with or link to third-party services (LinkedIn, company websites, etc.). We are not responsible for:

• The content, accuracy, or practices of third-party services
• Any transactions or interactions you have with third parties
• Third-party terms of service or privacy policies

Your use of third-party services is at your own risk.

"As Is" Service

GreatHearts is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security or freedom from viruses

Career Outcomes

We do not guarantee any career outcomes, job placements, salary increases, or professional advancement. GreatHearts is a tool to showcase your work. Success depends on many factors beyond our control.

User Content

We do not endorse or verify the accuracy of user-submitted content. Profiles represent self-reported information.

11. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Any damages arising from your use of or inability to use the platform
• Actions or content of other users, employers, or recruiters
• Any employment decisions or outcomes

Our total liability for any claim related to these terms or the platform is limited to the amount you paid us (if any) in the 12 months before the claim arose, or R1,000, whichever is greater.

These limitations apply regardless of the theory of liability (contract, tort, negligence, or otherwise).

12. Indemnification

You agree to indemnify and hold harmless GreatHearts, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the platform
• Your Content
• Your violation of these terms
• Your violation of any third party's rights

13. Termination

By You

You may delete your account at any time through your account settings or by contacting us. Upon deletion, your profile will be removed and your data deleted in accordance with our Privacy Policy.

By Us

We may suspend or terminate your account if you:

• Violate these terms
• Engage in fraudulent or illegal activity
• Misuse the platform or harm other users
• For any other reason at our discretion, with reasonable notice

Effect of Termination

Upon termination:

• Your right to use the platform ends immediately
• Your profile will be unpublished
• We may delete Your Content (subject to legal retention requirements)
• Provisions that should survive termination will remain in effect

14. Dispute Resolution

Informal Resolution

Before filing any formal claim, you agree to contact us at legal@sarejects.com and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These terms are governed by the laws of the Republic of South Africa.

Jurisdiction

Any disputes arising from these terms or your use of GreatHearts will be resolved in the courts of Johannesburg, South Africa, and you consent to the jurisdiction of those courts.

15. Changes to Terms

We may modify these terms from time to time. We'll notify you of material changes via email or a notice on the platform at least 14 days before they take effect.

Your continued use of GreatHearts after changes take effect constitutes acceptance of the new terms. If you don't agree, you should stop using the platform and delete your account.
